Objectives of the Course This course aims to:

Provide theoretical and practical knowledge on the fundamental concepts and institutions related to private law entities established by the administration or entrusted with public service delivery, (1.1.)

Examine the constitutional and administrative dimensions of activities carried out by private legal entities such as foundations, associations, and corporations for the public good, within the framework of Constitutional Court and Council of State decisions, (2.3.)

Develop a critical understanding of the delegation of public powers to private law entities and the boundaries of such delegation within the evolving notion of public service, (3.2.2.)

Encourage analytical thinking and alternative solutions to legal and administrative challenges arising in models such as public-private partnerships or the status of public benefit associations, (2.2.)

Enable students to follow recent developments regarding private law entities operating under administrative supervision and to comprehend the regulatory framework governing these activities (3.2.1.).
Course Content This course examines the legal nature of public activities carried out by private law entities, including those established by administrative authorities. Within this framework, it explores forms of participation of private actors in public service delivery, public benefit associations and foundations, the supervisory and regulatory powers of the administration over private entities, and the public roles of institutions such as foundation universities and professional organizations. Furthermore, the course addresses the transformation of the public service concept, focusing on public-private partnership models, administrative concessions, public procurement involving private entities, the transfer of public resources to private organizations, and the judicial review of such processes.
Course Methods and Techniques Zoom, Perusall and drive-based applications are used.
