Objectives of the Course This course aims to deepen participants' understanding of the intricate relationship between ethics and law. Over the first four weeks, we delve into the ethical dimensions of contemporary scientific advancements, particularly the connectome and artificial intelligence, questioning the human role as an ethical subject. The subsequent four weeks focus on dissecting Utilitarian, Kantian, Virtue Ethics, and Religious ethical theories, exploring their influence on individual choices and legal decisions. The remainder of the course hones analytical skills through the critical analysis of concrete court decisions, distinguishing instances where ethical considerations guide legal reasoning. Ultimately, the objective is to empower participants to contribute to fairer and more nuanced solutions by comprehending the complex interplay between ethics and law in decision-making processes.
Course Content In this course, the structural relationship of ethics and law beyond superficial discussions will be discussed. In the first 4 weeks, the possibility of human being as an ethical subject in the face of today's scientific developments, especially connectome and artificial intelligence, will be put forward as a problematic. In the second 4 weeks, the most accepted Utilitarian, Kantian, Virtue Ethics (Aristotelian) and Religious ethical theories will be discussed in terms of their role in our choices and the way they guide our behaviour, and as an extension of this quality, the extent to which they are effective in legal decisions will be determined. In the remaining weeks, the participants will be expected to analyse concrete court decisions that show the guiding role of ethical thinking or, on the contrary, that contain argumentation away from ethical considerations.
Thus, it will be tried to develop the ability to reach fairer solutions and decisions by understanding the various and complex forms of relationship between ethics and law.
