Objectives of the Course The aim of this course is to address, evaluate and discuss important issues in Turkish international procedural law.
Course Content The entirety of the procedural rules that resolve civil procedural law issues that arise in relation to foreign litigation parties or events and relations connected to a foreign country is called international (civil) procedural law.
In this course, the international jurisdiction of Turkish courts, other rules regulating events and relations connected to foreign countries that are important in terms of procedural law, rules related to the status of foreigners in the case (for example, rules regarding the capacity of foreigners to sue and the capacity of foreigners to be a party, rules regulating the obligation to show security due to foreignness or rules that impose special conditions for foreigners to benefit from judicial assistance), and the recognition and enforcement of foreign court and arbitral awards, The rules governing the effects of procedural acts, such as the institution of a lawsuit attempted in a foreign country, on the domestic law, the effect and force of foreign means of proof, the proof of foreign law in litigation, and finally the rules governing the notification and invitations to be made in foreign countries (i.e. international legal assistance) are discussed.
